Arbitration Agreement: You and TimeshareX agree that any disputes arising from these Messaging Terms and Conditions or your receipt of text messages from TimeshareX will be resolved through binding arbitration. Arbitration is a less formal process than a lawsuit, utilizing a neutral arbitrator instead of a judge or jury, and it can offer more streamlined discovery processes and limited court review. This agreement to arbitrate includes all claims regardless of the legal theory and irrespective of when the claim arises. By agreeing to these terms, you and TimeshareX waive the right to a trial by jury or to participate in a class action, and these terms are governed by the Federal Arbitration Act.

Exceptions: This arbitration agreement does not prevent you or TimeshareX from seeking temporary or preliminary injunctive relief in a court of competent jurisdiction, filing individual claims in small claims court, or filing suit for intellectual property infringement.

Arbitration Procedures: Arbitration will be conducted by the American Arbitration Association (AAA) under its rules, which are available at www.adr.org. If arbitration is sought, the initiating party must send a notice of the dispute to the other party via U.S. Mail, outlining the nature and basis of the claim and the relief sought. TimeshareX’s address for notices is 435 N Mulford Rd STE 7, Rockford, IL 61107. If a resolution is not reached within 30 days, either party may commence arbitration.
